RichTVX.com™ Data Handling Protocol

RichTVX.com™ (hereafter referred to as “the Agency”) operates RichTVX.com and affiliated digital assets. This document delineates the Agency’s data handling procedures, emphasizing the protection of user privacy.

User Identification: Non-Personally Identifying Data

The Agency, consistent with standard operational protocols, logs non-personally identifying user data. This includes browser specifications, preferred language settings, referrer URLs, and timestamps. The Agency’s intent in collecting this data is to analyze and assess user interaction with the Agency’s digital assets, thereby informing strategic operational adjustments. Aggregate, non-personally identifying data may be released periodically, for instance, in reports detailing overall usage patterns.

User Identification: Potentially Personally Identifying Data

The Agency also collects potentially personally identifying data, specifically, Internet Protocol (IP) addresses. This is done for users accessing the system with credentials and for those leaving communications on Agency blogs/sites. The Agency’s protocols for disclosure of this data are consistent with those for personally identifying data, as detailed below. However, IP addresses and associated email addresses of those communicating on Agency digital assets may be accessible to site administrators.

Collection of Personally Identifying Data

Specific user actions on the Agency’s digital assets require the collection of personally identifying data. The quantity and nature of collected information are directly correlated with the user’s interaction with the Agency. For example, new user registration requires the submission of usernames and email addresses. Those engaging in financial transactions with the Agency must provide the necessary personal and financial details for operational purposes. In all cases, the Agency collects only that information that is directly and demonstrably required for the given user interaction. Personally identifying information is not disclosed unless under the conditions detailed below. Users retain the option to withhold such data, with the understanding that such actions may impede access to certain Agency digital assets.

Statistical Aggregation

The Agency compiles statistical data regarding user behavior on Agency digital assets. This data may be made publicly available or provided to third parties. However, the Agency does not disclose personally identifying data except as detailed in this document.

Protection of Personally Identifying Data

The Agency’s disclosure of potentially and personally identifying information is strictly limited to Agency personnel, contractors, and affiliate organizations. These entities must have a demonstrable need for the data to carry out their designated tasks, as determined by the Agency, and they must agree to not disclose the information to other parties. It is acknowledged that such personnel, contractors, and affiliate organizations may reside outside of the user’s home nation. By using the Agency’s digital assets, users consent to such data transfers. The Agency will not transfer user data for commercial purposes. Disclosure beyond these operational parameters will only occur in response to a subpoena, legal order, or other official request, or if the Agency determines such action necessary to protect Agency assets, third-party interests, or the collective safety. The Agency may send periodic communications to registered users, using provided email addresses, for operational updates, feedback solicitation, or Agency communications. Requests sent to the Agency via email or feedback mechanisms may be reproduced for operational needs. The Agency utilizes reasonable countermeasures to protect against unauthorized access, use, manipulation, or destruction of potentially and personally identifying information.

Data Logging: Cookies

The Agency utilizes cookies, small text files stored on user devices, for the purpose of identification and tracking of user activity, usage of Agency digital assets, and to retain user preferences. Users wishing to disable cookie functionality may configure their browser settings accordingly. However, such actions may impair the optimal performance of the Agency’s digital assets.

Data Transfers: Operational Continuity

In the event of an acquisition of the Agency or its assets, or if the Agency ceases operations or declares insolvency, user data may be transferred to a third party as part of the asset transfer. Users agree to these potential data transfers and acknowledge that the acquiring party may use such data consistent with this document.

Third-Party Content: Advertising

Advertisements on the Agency’s digital assets may be delivered by third-party advertising partners, who may utilize cookies. This enables these partners to identify devices and collect data for the purposes of targeted advertisement delivery. This document does not cover the use of cookies by third-party advertisers.

Policy Modifications

The Agency retains the right to modify this document unilaterally, at its sole discretion. Users are advised to periodically review this document for changes. Registered users may also receive alerts of any changes. Continued use of the Agency’s digital assets after such modifications indicates user acceptance of such changes.

YouTube API Services Integration:

The Agency integrates with YouTube API Services, thereby subjecting users to the Terms of Service delineated below.

YouTube Terms of Service Summary

**Service Overview:** The YouTube service is a platform for content discovery, consumption, and sharing, also serving as a channel for content creators and advertisers. Detailed operational information is available in the YouTube Help Center.

**Service Provider:** Within the European Economic Area (EEA) and Switzerland, the service is provided by Google Ireland Limited. Affiliated entities within the Alphabet Inc. corporation are referenced in these terms as YouTube “Affiliates”.

**Governing Terms:** Use of the service is governed by these terms, as well as the YouTube Community Guidelines, and the Policy, Safety, and Copyright policies (together, the “Agreement”). Advertising activities are further subject to the Advertising on YouTube policies. Use of the service indicates agreement with these terms.

**User Eligibility:** Users must be at least 14 years of age; however, younger users may use the service, including YouTube Kids, with parental consent. Users under 18 years of age must have parental permission, and parents must review these terms with their children. Businesses operating on the service must have authorization to do so.

**Service Utilization:** Content on the service includes diverse media and is the responsibility of the providing party. YouTube is a hosting service provider. Reporting mechanisms are available for content that is deemed non-compliant with these terms. Google accounts are required for use of some service features. Account security is the user’s responsibility.

**Data Handling:** User data handling is subject to the YouTube Privacy Policy and, where applicable, the YouTube Kids Privacy Notice. Audio or audiovisual content is processed consistent with YouTube Data Processing Terms.

Permissions and Restrictions

Users have permission to access and utilize the service in accordance with these terms and applicable laws, for personal, non-commercial use. Specific restrictions apply:
* Access, reproduction, and distribution of content, outside of specified permissions, is prohibited.
* Security features, use limitations, and access controls must not be circumvented.
* Automated access is restricted, except for permitted search engines.
* Data harvesting is prohibited without explicit consent or legal justification.
* Distribution of unsolicited content or other forms of spam is prohibited.
* Manipulation of metrics and use of the platform for generating profit is restricted to specific circumstances.
* Use of any reporting mechanisms for false reporting is prohibited.
* Contests must comply with YouTube policies.

Service Modification

The service is continually modified for functionality, technological, and legal reasons. Users may be provided notice of changes that impact service utilization, in line with these terms.

User-Provided Content

Users uploading content must ensure its compliance with these terms. Users grant to YouTube a license to use uploaded content for operational purposes. Users also grant other users the right to access content through the service as enabled by the features. Licenses remain in effect until content is removed, with some exceptions. YouTube has monetization rights for all content, with no payments guaranteed to users through these terms. Users may remove content; however, the platform can also remove content deemed in breach of these terms. YouTube operates a strike system for non-compliant content, potentially resulting in account termination. Copyright infringement notices may be issued and lead to termination of accounts of repeat offenders.

Account Termination

Users may stop using the service at any time. YouTube reserves the right to suspend or terminate user accounts for breach of these terms or legal obligations. Termination notices may be issued. Following termination, usage restrictions apply. Termination appeals may be lodged.

Software Utilization

User access to software includes a non-assignable license for use of the service, unless otherwise specified in applicable software licenses. Copying, distribution, and reverse engineering of the software are prohibited without explicit permission. Some software is provided via open-source licenses which may override some terms.

Legal and Other Terms

Users within the EEA have a legal guarantee for digital services. YouTube does not offer additional service guarantees, other than what is laid out in the terms. Users must comply with applicable laws and agree to the limitations of YouTube liability. The platform assumes no responsibility for third party links. YouTube retains the right to modify these terms, and provide advance notice when appropriate. Certain terms survive termination of service use. Failure to comply with these terms will not constitute any waiver of YouTube’s rights to enforce the agreement. Service provision and relationship between YouTube and users residing within the European Economic Area (EEA) or Switzerland will be governed by local laws.

EEA Withdrawal Instructions

EEA based customers may withdraw from this contract with 14 days without giving any reason. See detailed instructions for withdrawal, including withdrawal form and regional contact information.
